KENAI PENINSULA BOROUGH ORDINANCE 89-54

AMENDING THE BOUNDARIES OF THE ANCHOR POINT FIRE AND EMERGENCY MEDICAL SERVICE AREA TO DELETE THAT PORTION OF THE SERVICE AREA LYING OUTSIDE OF THE ANCHOR POINT VOTING PRECINCT.

WHEREAS, on August 15, 1989, the Assembly unanimously enacted Ordinance 89-38, which provided for expansion of the boundaries of the Anchor Point Fire and Emergency Medical Service Area; and

WHEREAS, the legal description of that expanded service area contained in Ordinance 89-38 contained a small portion of lands located outside of the Anchor Point voting precinct which were beyond the expanded boundaries proposed by the Anchor Point Fire and Emergency Medical Service Area Board in their final request for expansion: and

WHEREAS, the voters of the expanded APFEMSA voted to approve the expansion at the election of October 3, 1989; and

WHEREAS, out of a total of 227 votes cast in that election there were a total of two votes cast from the expansion area outside of the Anchor Point precinct; one "for" and one "against" expansion; and

WHEREAS, the Board of Directors of the APFEMSA, at their meeting of October 5, 1989, unanimously approved a motion to request that the Assembly delete that portion of the expanded service area located outside of the Anchor Point voting precinct based upon the Board's concern that the service area could not efficiently and effectively provide emergency services to that area;

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:

Section 1. That KPB 16.60.010 is amended to read as follows:

16.60.010 Boundaries. There is established a service area within the Borough designated as the "Anchor Point Fire and Emergency Medical Service Area, in that portion of the Borough described as follows:

All of the following referenced to the Seward Meridian, Alaska:

All uplands of T3S, R14W, EXCEPTING therefrom those portions of Sections 4, 5, 6 and 7 lying northwesterly of the thread of Happy Creek;

All uplands of T3S, R15W;

All of T4S, R14W;

All uplands of T4S, R15W;

All of T5S, R14W, EXCEPTING therefrom all sections and portions of sections lying southerly and southeasterly of the following described line: beginning at the point of intersection of the range line common to T5S, R13W and R14W and the thread of Anchor River; thence southwesterly along the thread of Anchor River to the point of intersection with the line common to Sections 28 and 29; thence south along said common line and continuing along the line common to Sections 32 and 33 to the north 1/16th corner common to said Sections 32 and 33; thence west along the north 1/16th line through Section 32 and continuing through Section 31 to the north 1/16th corner of Section 31 on the range line common to T5S, R14W and R15W being the terminus of this line description;

All uplands of T5S, R15W, EXCEPTING therefrom those portions of Sections 35 and 36 lying southerly of the north 1/16 line of said Sections 35 and 36;

All being within the Anchor Point voting precinct.

Section 2. That this ordinance takes effect on January 1, 1990, except that no services shall be provided within the areas of expansion until July 1, 1990.
