KENAI PENINSULA BOROUGH
ORDINANCE 93-10
AN ORDINANCE INCREASING THE KPB SCHOOL
BOARD FROM SEVEN TO NINE MEMBERS AND HAVING THEM ELECTED FROM
DISTRICTS
WHEREAS,an application for initiative
petition has been received by the Borough Clerk to provide for a
9 member school board to be elected by districts with the same
boundaries as the assembly districts; and
WHEREAS,AS 14.12.030 allows the size of the
school board to be set by ordinance at 7, 9, or 11 subject to
voter approval; and
WHEREAS,AS 29.20.300 requires that any method
of electing school board members other than at large must be
approved by the voters at a regular municipal election; and
WHEREAS,enactment of an ordinance containing
substantially the same provisions eliminates the need to handle
the initiative process and eliminates any conflicts that can
occur between an initiative at a special election and the regular
election requirement contained in AS 29.20.300 and AS 14.12.030;
NOW THEREFORE BE IT ORDAINED BY THE ASSEMBLY OF THE
KENAI PENINSULA BOROUGH:
SECTION 1.That KPB 1.20.100 is amended to
read:
1.20.100. School board -- Number of seats -- Term of office -- Designation of seats.
A. There is established a school board for the Kenai Peninsula Borough School District, composed of nine [SEVEN] members, who shall be nominated and elected by the qualified voters of the borough as provided in the borough code of ordinances. Board members shall be elected by districts [AT LARGE]. Each member shall reside in and be elected by the voters within that district. The districts and seat designations for school board seats shall be the same as established for the assembly in KPB 22.30.010.
B. School board members are elected at the regular borough
election, for three-year terms, and serve until their successors
take office.
SECTION 2.That the term of office of all
existing school board members shall terminate with the first
election following approval by the voters of the form of
representation and size of school board provided by this
ordinance.
SECTION 3.Notwithstanding any provisions of
this ordinance or the borough code establishing a 3 year term for
school board members, the initial terms of office for the nine
member school board shall be as follows: Seats 1, 6, 9 for 1
year; seats 3, 4 and 7 for 2 years; and seats 2, 5 and 8 for 3
years.
SECTION 4.That the establishment of a 9
member school board elected by districts corresponding to the
assembly districts shall be placed before the voters for approval
at the regular municipal election to be held in October 1993.
SECTION 5.That sections 1, 2, and 3 of this
ordinance take effect upon approval by the voters of the
composition and form of representation established therein. All
other sections of this ordinance shall take effect immediately
upon their enactment.
