KENAI PENINSULA BOROUGH

ORDINANCE 2005-19-47 (MAYOR) SUBSTITUTE

 

AN ORDINANCE APPROPRIATING $1,000,000 FROM THE BOROUGH’S GENERAL FUND BALANCE TO REIMBURSE THE CES CAPITAL PROJECT FUND FOR ITS CONTRIBUTION FOR CONSTRUCTION OF AN EMERGENCY RESPONSE CENTER

 

WHEREAS,  Ordinance 2004-19-29 appropriated $2,473,693 for the construction of an emergency response center with funding provided by grants totaling $2,473,693, from CES in the amount of $1,000,000 and from the Borough’s General Fund in the amount of $239,835; and

 

WHEREAS,  at its meeting of November 18, 2004, the CES Board of Directors previously approved the expenditure of up to $1 million for this project; and

 

WHEREAS, at its meeting of January 19, 2006, the CES Board of Directors and administration re-evaluated the above action and voted to opt out of their participation in this project and seek reimbursement of the funds they had previously committed to this project. The CES board and administration believe that the residents of the service area would be better served by having their administration in the same building as their equipment and crew. Having the CES administration in a separate building across the street from the equipment and crew would create communication and operational difficulties in a department that relies heavily on strong communication capabilities and the ability to react immediately to emergencies; and

 

WHEREAS,  the return of these funds will allow the Service Area to purchase some of the equipment needed for the new stations at Funny River and Kasilof areas; and

 

WHEREAS,  funding from the general fund will be necessary to cover the amount that CES had contributed to the project; and

 

WHEREAS,  using the general fund for this purpose is appropriate as the two remaining occupants of the building, E-911 and the Office of Emergency Management, are funded with areawide funds from the general fund; and

 

WHEREAS,  in order to minimize the impact of this action upon the general fund, repayments could be made in four equal installments of $250,000 per fiscal year; and

 

WHEREAS,  at its regular meeting of May 18, 2006, the Central Emergency Service Area Board recommended approval of the substitute ordinance 2005-19-47;

 

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:

 

SECTION 1.  That $250,000 be appropriated from the Borough’s General Fund, fund balance account 100.00000.00000.27910 to account 100.94910.00000.50443 for transfer to the CES Capital Project Fund.

 

SECTION 2.  That the assembly hereby states its intention to also appropriate $250,000 in the fiscal year 2007, 2008, and 2009 budgets from the Borough General Fund account 100.00000.00000.27910 to account 100.94910.0000.50443 for transfer to the CES Capital Project Fund as full reimbursement to CES of its contribution to the above-described facility.

 

SECTION 3.  That this ordinance takes effect immediately upon its enactment.
