SUBJECT:    Ordinance No. 2006-19-32: Accepting and appropriating a $65,000 state grant from DCCED and authorizing a sole source agreement with DOT/PF for a safety trail along Diamond Ridge Road

Residents in the Homer Area have requested that a safety trail be constructed along Diamond Ridge Road. Currently there is no trail and pedestrians must walk on the roadway, thus creating an extremely unsafe condition. Their request for funding for this project was included in the Borough’s 2006 Legislative Priorities.


Funding for the project was included in Senate Bill 231, the State’s capital budget, which was passed by the Legislature and signed by the Governor in July 2006. The State Department of Commerce, Community and Economic Development has notified the Borough that $65,000 is available for a non-motorized vehicle safety trail along Diamond Ridge Road. Enactment of the attached ordinance would accept the grant and appropriate the funds.


Diamond Ridge Road is a state-maintained road. Construction of the safety trail would be within the State’s right-of-way. The State is the only entity with authority to conduct activities upon its property. Therefore, if the attached ordinance is enacted, it is the intent of the Borough Administration to enter into a transfer of responsibility agreement with the Alaska Department of Transportation and Public Facilities. They have indicated that they would be willing to accept the grant funds. DOT/PF would use the funds to survey the prescriptive rights along Diamond Ridge Road. (See attached email from DOT/PF). The attached ordinance gives the Mayor the authority to enter into an agreement with DOT/PF.
