KENAI PENINSULA BOROUGH

ORDINANCE 2006-27

 

AN ORDINANCE CHANGING THE NAME OF CENTRAL KENAI PENINSULA HOSPITAL SERVICE AREA TO HEALTHCARE SERVICE AREA OF THE CENTRAL PENINSULA, AND CHANGING THE NUMBER OF MEMBERS OF THE BOARD FROM SEVEN TO NINE

 

WHEREAS,  in 1969 with Ordinance 69-3, the assembly established the Central Kenai Peninsula Hospital Service Area (“CKPHSA”), and, in a special election held in 1969, the voters approved the exercise of powers in the service area to construct, maintain, and operate hospitals; and

 

WHEREAS,  Ordinance 69-3 provided for an appointed hospital board to advise the assembly and mayor (then “chairman”) concerning the administration and operation of the service area, to review the annual budget, and to perform other functions as directed by the assembly; and

 

WHEREAS,  in Ordinance 92-54, the assembly abolished the service area board and recognized that the service area board members would serve as the board members of CPGH, Inc., which would manage the hospital for the service area; and

 

WHEREAS,  in 1997 with Ordinance 97-41, the assembly, subject to voter approval, expanded the powers that may be exercised by the borough in the service area to include the provision of numerous additional healthcare services; and

 

WHEREAS,  the voters approved this expansion of powers in the October 1997 election; and

 

WHEREAS,  the assembly re-established the Central Kenai Peninsula Hospital Service Area board by enacting Ordinance 97-70, which outlined the duties and responsibilities of the CKPHSA board; and

 

WHEREAS,  KPB 16.08.015 states:

 

         The Central Kenai Peninsula Hospital Service Area is authorized to construct, maintain, and operate a hospital or hospitals, to establish and to operate, or to participate in the expense of operating, a center for the treatment of alcoholism and chemical dependency, and to provide other health services or health facilities within the service area, including but not limited to: primary health care, health promotion and chronic disease services (including psychiatric treatment, mental health and rehabilitation services), outpatient services, health education, preventive medical care and wellness programs, home health services, personal care services, long term care, and hospice care, subject to such conditions as may be established by ordinance of the Kenai Peninsula Borough; and

 

WHEREAS,  the CKPHSA Board has reviewed KPB Chapter 16.08 and Ordinances 97-41, 97-70, 69-3, and Resolution 98-091; and

 

WHEREAS,  in accordance with the expanded duties and powers of the service area, the CKPHSA Board acknowledges that its duties are to the service area’s health needs and not just in relation to the hospital as the existing name states; and

 

WHEREAS,  as the service area board has become increasingly active in numerous aspects of healthcare services, an additional two board members are needed to adequately perform the board’s duties;

 

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:

 

SECTION 1.  That the title of KPB Chapter 16.08 is hereby amended as follows:

 

CHAPTER 16.08. [CENTRAL KENAI PENINSULA HOSPITAL SERVICE AREA] HEALTHCARE SERVICE AREA OF THE CENTRAL PENINSULA

 

SECTION 2.  That the first paragraph of KPB 16.08.010 is hereby amended as follows:

 

16.08.010. Established—Boundaries.

 

       There is established a service area within the borough, designated the [“Central Kenai Peninsula Hospital Service Area,”] “Healthcare Service Area of the Central Peninsula,” including that portion of the borough described as follows:

 

SECTION 3.  That KPB 16.08.015 is hereby amended as follows:

 

16.08.015. Authorized functions of the [Central Peninsula Hospital Service Area] Healthcare Service Area of the Central Peninsula.

 

       The [Central Kenai Peninsula Hospital Service Area] Healthcare Service Area of the Central Peninsula is authorized to construct, maintain, and operate a hospital or hospitals, to establish and to operate, or to participate in the expense of operating, a center for the treatment of alcoholism and chemical dependency, and to provide other health services or health facilities within the service area, including but not limited to: primary health care, health promotion and chronic disease services (including psychiatric treatment, mental health and rehabilitation services), outpatient services, health education, preventive medical care and wellness programs, home health services, personal care services, long term care, and hospice care, subject to such conditions as may be established by ordinance of the Kenai Peninsula Borough.

 

SECTION 4.  That KPB 16.08.020 is hereby amended as follows:

 

16.08.020. Board—Established—Nomination and election.

 

       There is established a board of directors for the [Central Kenai Peninsula Hospital Service Area] Healthcare Service Area of the Central Peninsula, known as the Healthcare Service Area Board of the Central Peninsula composed of [7] nine members who shall be nominated and elected by the qualified voters of the service area as provided in the borough elections code and KPB 16.04.065.

 

SECTION 5.  That KPB 16.08.030 is hereby amended as follows:

 

16.08.030. Board—Meetings—Quorum.

 

       The board shall meet periodically at a regularly scheduled time and place designated by the board. Special meetings of the board may be called by the chair of the board or by 3 members upon 1 day’s notice. The notice shall set forth the time and place of the meeting and shall be mailed or telephoned to each member. The attendance of a member at a meeting constitutes a waiver of notice of the meeting. All meetings are open to the public as provided in AS 29.20.020 and AS 44.62.310 and in accordance with the policies set forth in AS 44.62.312. [Four] Five members shall constitute a quorum, and if a quorum is present, actions may be taken by a majority vote of those members present.

 

SECTION 6.  That KPB 16.08.050 is hereby amended as follows:

 

16.08.050. Board—Qualifications and terms of office.

 

       Members shall be qualified voters of the borough who are residents of the service area. Members shall be elected to Seat A for a term of 1 year, and seats B through [G] I for a term of 3 years, except that the first board shall contain members elected to Seats B and C for initial terms of 1 year and to Seats D and E for initial terms of 2 years in order to provide for staggered terms.

 

SECTION 7.  That KPB 5.20.150 is hereby amended as follows:

 

5.20.150. Central peninsula hospital service area fund.

 

       The central peninsula hospital service area fund is established to account for all revenues from taxes or other sources. Appropriations and disbursements from the central peninsula hospital service area fund shall be made for the [central peninsula hospital service area] Healthcare Service Area of the Central Peninsula functions of the borough.

 

SECTION 8.  That this ordinance takes effect immediately upon its enactment.
