KENAI PENINSULA BOROUGH
ORDINANCE 2006-31
(SPRAGUE, MARTIN) SUBSTITUTE
AN ORDINANCE SEEKING VOTER APPROVAL FOR THE BOROUGH
TO CONTINUE TO EXERCISE TRANSPORTATION FUNDING POWERS
WHEREAS, in Ordinance 2000-19-06, the assembly enacted KPB Chapter 13.10, Transportation, and adopted transportation funding powers; and
WHEREAS, Ordinance 2000-19-06 was scheduled to automatically terminate on September 12, 2001, unless extended by ordinance; and
WHEREAS, in Ordinance 2001-27, the assembly extended for five years KPB Chapter 13.10 and provided that it would automatically expire on September 30, 2006, unless extended by ordinance, provided that any grants or contracts awarded before September 30, 2006, would continue in full force and effect; and
WHEREAS, transportation systems as used in this ordinance means conveyance services provided by vehicles, which may include buses, boats, airplanes, and other conveyances, but does not include roads; and
WHEREAS, the interests of the people of the borough would best be served by placing this question of the permanent adoption of transportation system powers on the October 2006 ballot;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:
SECTION 1. That the following proposition shall be placed on the ballot for the regular election to be held October 3, 2006:
SHALL THE KENAI PENINSULA BOROUGH HAVE THE AUTHORITY TO FUND TRANSPORTATION SYSTEMS ON AN AREAWIDE BASIS?
SECTION 2. That if the proposition in Section 1 is approved by the majority of the voters voting on the question, then the repeal date of September 30, 2006, in Ordinance 2001-27 shall be repealed, and Ordinance 2000-19-06 shall remain in full force and effect until repealed by the assembly or voter action. If the proposition in Section 1 is not approved by the majority of the voters voting on the question, then the repeal date of September 30, 2006, in Ordinance 2001-27 shall be amended to December 31, 2006.
SECTION 3. That section 1 of this ordinance shall take effect immediately upon its enactment. Section 2 of this ordinance shall take effect upon certification of the regular election to be held October 3, 2006.
