KENAI PENINSULA BOROUGH
RESOLUTION 98-057

A RESOLUTION PLACING A NONAREAWIDE ADVISORY VOTE ON THE OCTOBER 1998 BALLOT QUESTIONING WHETHER THE BOROUGH SHOULD EXERCISE LIMITED ANIMAL CONTROL POWERS IN THE AREAS OF THE BOROUGH OUTSIDE OF THE CITIES

WHEREAS, the borough is a second class general law municipality and, pursuant to AS 29.35.210, may license, impound, and dispose of animals on either an areawide or nonareawide basis by ordinance without voter approval; and

WHEREAS, the assembly has considered several proposed animal control ordinances during the last few years and has failed to adopt any such ordinance; and

WHEREAS, it is desirable to provide borough voters residing in the areas of the borough outside of the cities with the opportunity to advise the assembly on whether or not the voters would support the borough's exercise of limited animal control powers in the areas of the borough outside of the cities:

NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:
