A RESOLUTION PLACING A NONAREAWIDE ADVISORY VOTE ON THE OCTOBER
1998 BALLOT QUESTIONING WHETHER THE BOROUGH SHOULD EXERCISE LIMITED ANIMAL CONTROL POWERS
IN THE AREAS OF THE BOROUGH OUTSIDE OF THE CITIES
WHEREAS, the borough is a second class general law municipality and,
pursuant to AS 29.35.210, may license, impound, and dispose of animals on either an
areawide or nonareawide basis by ordinance without voter approval; and
WHEREAS, the assembly has considered several proposed animal control
ordinances during the last few years and has failed to adopt any such ordinance; and
WHEREAS, the first class cities in the borough all provide animal
control services for city residents and borough residents living outside the cities; and
WHEREAS, because the city animal control services are funded by the
cities, cities subsidize the provision of animal control services for the borough
residents residing outside of the cities; and
WHEREAS, due to the increasing population throughout the borough, the
borough's best interests may be served by providing limited animal control services in the
areas of the borough outside of the cities; and
WHEREAS, it is desirable to provide borough voters residing in the
areas of the borough outside of the cities with the opportunity to advise the assembly on
whether or not the voters would support the borough's exercise of limited animal control
powers in the areas of the borough outside of the cities:
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:
SECTION 1. That a question in substantially the following form shall
be placed before the voters residing in areas of the borough outside of the cities at the
regular election to be held October 6, 1998, as an advisory vote:

outside of the cities at this time? (This is an advisory vote only).
