SUBJECT:    Resolution 2006-080, transferring $50,000 from FY03 and FY04 Areawide Fire Marshal Compliance to FY05 Areawide ADA Handicap Improvements

The Americans with Disabilities Act (“ADA”) requires certain improvements to accommodate disabled people. Attached please find a resolution authorizing the transfer of $50,000 from an existing FY 2003 and FY 2004 areawide project account, Fire Marshal Code Compliance (400.78050.03856 and 400.78050.04856), to an existing FY 2005 areawide project account, ADA Handicap Improvements (400.78050.05782).

Essential Fire Marshal Code Compliance issues were addressed with alternate funds, as such compliance was necessary for housing athletes competing in the Arctic Winter Games.

As a result, most of the unencumbered and unexpended funds in the Fire Marshal Code Compliance account will not be expended for their intended purpose, while the funds in the Areawide ADA Handicap Improvements account are nearing depletion.

Transferring the funds into the Areawide ADA Handicap Improvement account will allow the maintenance department to continue its fairly aggressive program of addressing ADA compliance issues, without waiting for potential FY 2008 funds to become available in the latter part of the summer of 2007.

The Borough Assembly's consideration of the attached resolution is respectfully requested.
